As of October 3, 2023, Session Law 2023-134 became effective, which provides revisions to North Carolina General Statute § 143-49 Powers and duties of Secretary.
As part of these revisions, a clause must be included in all contracts awarded by the state, and departments, agencies, and institutions of the state, providing that the following entities may audit the records of the contractor during and after the term of the contract to verify accounts and data affecting fees or performance:
- The State Auditor
- The internal auditors of the affected department, agency, or institution
- The joint Legislative Commission on Governmental Operations and legislative employees whose primary responsibility is to provide professional or administrative services to the commission
Therefore, any contract awarded by the state, and departments, agencies, and institutions of the state, on or after October 3, 2023, must contain this language.
The Division of Purchase and Contract has revised the North Carolina General Terms and Conditions to reflect this language and this version of the terms and conditions shall be included in all solicitations and contracts going forward.
All contracts awarded on or after October 3, 2023, that do not contain the latest version of the North Carolina General Terms and Conditions must be amended to include this language.
